But can negligence be cause for damages?

And the story alluded to possible dram shop liability for the bar(tenders) who serve these people. It’d be essentially the same cross exam Atch outlines, except substitute the bartender for the girl drinking, and note that they saw the shot book and knew they were serving someone their 12th shot of the night.

there's a question
if the bartender sees the book, is it their responsibility to tract drinks heading to said drinkers table and determine what is enough? Further, if the group (a stereotype, but assuming these girls went out in groups) is moving between bars, does the responsibility of the following bartenders/bars heightened? Should bouncers check books?
Seems like there’s just too many lose strings. Not my area of expertise, which adds to my confusion.

Being drunk isn’t a crime, but a whole lot of crimes and liability follow from drunkeness. The cross examination goes a little something like this:
Q. Had you been drinking before the accident that paralyzed Mrs. Jones and killed her three year old daughter?
A. I’d had one drink to celebrate my birthday.
Q. Have you seen this book before?
A. Yes.

Q. And it’s called a “shot book” because it shows you drinking shots of liquor, correct?

Q. And these photos were all taken the night of the accident that left Mrs. Jones paralyzed and her daughter dead?

A. That’s a shot called Sex on the Beach?

She said they used to have shot cards, but nothing like taking pictures. They would keep track of shots they took. This again, was only 2-3 years ago.
So this scrap booking thing has started since.
I blame the be-dazzler if you ask me.

Was my boss when I worked at KMIZ. great guy. I went back to a game this season and told him I was planning on going to the Rams game the following day. He asked me to stay in CoMO for an hour before driving to StL. He met up with me and handed me 2 tickets to the game. Classy move.
