Unbelievable. The five "leftovers" (KU, KSU, ISU, BU, Mizzou) agreed to sign over their share of CU/NU's buyout money to UT/OU/A&M.
Even though it's the best option right now, allow me to reiterate: God, I hate this conference...

Let's just call it a Monarchy.
With Texas as the King, OU as the Queen, and A&M as the in-bred heir to the throne.

Let us not forget:
1. There is no official new TV deal
2. We just have pledged publicly to being a member of the Big 12 Lite
Great moments are born from great opportunity.

the fact that there aren't any new punishments for leaving
mean it might not matter much in the end. With no new TV deal and no contracts keeping the band together, there’s really nothing to stop any of the ten remaining schools from jumping ship as soon as they secure a better offer.
Follow me on twitter.com/SteveCusumano
does it matter?
was there a doubt before this that we were a second class citizen in this deal? The other 5 were all raping us financially anyway, who cares if its one more thing?

I would be very surprised . . .

Um... really?
The volleyball national title may never leave the Big Ten again between NU and Penn State, unless Texas or a Pac-10 team gets on a ridiculous run.
seeing as how I'm not a Nebraska fan
it really doesn’t matter to me what their situation in the big 10 is.
I'm holding judgement for now...
but yeah, initial glance looks really, really bad. I’m VERY interested to see how Mizzou brass responds to this (press conference announced for 4 p.m., will include Alden, Deaton and Foresee, I believe).
I’m also interested how Texas and company justify this…I find it hard to believe this is designed as punishment directed towards Mizzou, though that would fit in with the ongoing narrative of this all being Mizzou’s fault.
Alden, Deaton and Foresee – I want to trust you guys…but you’re making it harder to do so. I really hope there’s a good explanation for this. With there not actually being a new TV deal and no new punishment for leaving the conference early, this might have been the only card the Lowly Five could play to keep Texas, A&M and Oklahoma around.

I think at this point. It is what it is.
Time for the Mizzou marketing department to pull together the promotional items for this fall and it needs to be something that makes reference to overcoming adversity and rising in the face of steep odds.
Nothing pulls Missourians and especially Mizzou fans together like the belief we are getting screwed. If Mizzou plays their cards right, we could leverage that emotion and become a symbol of success by sticking it to the man…..on the field.

Yes
Because as Bill stated already this morning, we succeed with the paltry amount of money we’re already getting.
I still think the MWC would get more money with the addition of the Big 12 North then it has now.
To me, thinking otherwise is exactly why Texas treats us and the rest of the North they way they do.
by mizzousundevil on Jun 15, 2010 1:31 PM CDT up reply actions
Why does that number keep dropping?
First we hear “$20 million, competitive with the SEC!”, then we hear “Well, that only applies to Texas. The second tier gets $15-17 million”, then it’s “Sorry Mizzou, you aren’t in the second tier, you get $14-16 million, plus you’re going to give your share of the penalty money to Texas”. When the “deal” finally gets finalized, that $5-7 million from the MWC might look pretty good.
Once that to-be-negotiated TV money runs through a UT escrow account before it’s distributed, MU’s cut will probably get paid out in pesos or cases of RC Cola.
As a Buff fan, I really feel terrible for the rest of the North having to stay in the Big 12-2 (Or really the Big 1 + a few other institutions). I’ll be rooting hard for you guys, but damn… UT is acting like the biggest A*hole ever. Thank goodness we got away when we did.
As an A&M fan said earlier, the Big 1+some others is not a conference, it’s a 3rd grade lunch room with a bully, his ass kissing lackeys and several wimps.

by TheHamburglar on Jun 15, 2010 12:59 PM CDT up reply actions
Ok, I can ALMOST understand the justification of keeping Missouri from getting the money
If you look at it from the perspective of “Missouri caused all of this, so they get none of the money.” We all know it’s bs, but given that it’s been the conference party-line for 2 weeks now, it makes sense.
However, why keep money from going to ISU, KSU, KU and Baylor? They did nothing except be loyal to the Big 12. If anything THEY should be getting the extra cut, as they didn’t even talk to another conference (not by their own choice, but still). Not only that, but Texas Tech is completely forgotten in this. They don’t have to give up their money, but they don’t get any extra?
In other words, this conference will no longer even give a PRETENSE of being about the best interests of all of its members. It’s about the best interests of UT, OU and A&M, everyone else can either be blatantly screwed, or just not get the outright benefits that they get. It has ceased to be an analogy of the bully saying “give me your lunch money or I’ll beat you up”, it is now literally the big schools saying “give me your share of the money or I’ll leave you out in the cold”.
Complete, unethical crap. In 5 years, we’ll be regretting not being in the MWC.
I regret it now
I’m so tired of Texas. Everything about the state is ticking me off. Let’s Mess With Texas all year. Let’s Show Them how big time we are.

This is why people take risks
So they won’t be screwed over like this. Honestly, we will be in the same position in the next 3-5 years and now I will have to hear how Mizzou started it. In reality, the BCS and NCAA started it and we just wanted to be in a more secure place within the conference.
The problem with taking risks is when your job is on the line...
…and no athletic director, chancellor, or university president … nobody at a position that high … is going to risk saying no and ending up in Conference USA. It’s why nobody has said no; they know they’ll lose their job if it doesn’t work out, and in those cases the 10% chance of something awful happening feels like 70%.

Someone please tell me this has been debunked by now
As ruthless at UT is about their own interests, they have worked too hard to position themselves as “Big 12 Savior” in the eyes of the unattentive to do something that would attract this much bad attention. As was pointed out above, even if they are ticked at Mizzou and trying to screw us, it makes no sense for them to do something that generates sympathy for ISU or K-State, who by pretty much all accounts have been innocent bystanders in this mess. Maybe I am being naive, though.
I am ready for some official reports. We have moved from hourly conference realignment scenarios to hourly Big 12 money scenarios. Where is Chip’s crystal ball when you need it?
12th Man Blog Notes on Big 12 Commissioner Dan Beebe's 6/15 Teleconference
(posted on The Ralphie Report http://www.ralphiereport.com/2010/6/15/1519413/12-man-blog-notes-on-dan-beebe-6#comments):
You can’t make this stuff up. This summary of the Big 12 teleconference today by I am the 12th Man, the SBNation Texas A&M blog, continues to show us why the Buffs made the right move to get out of the Big 12-2. Here are a few juicy parts but their are plenty of others worth your time at I am the 12th Man:
I just listened to the Dan Beebe live teleconference on the ‘new’ Big 12 Conference; some observations:
-Texas Tech has yet to commit to this new deal; he is hoping they do so later today. (I believe their Board of Regents meets today?)
-There is no official agreement from all the schools to stay together, just promises, handshakes, and commitments. Technically, this means there is still room for negotiations with other conferences, should a school still be inclined to leave.
-There are no concrete numbers on the new television deal; it is all based on just estimates. I guess no one in the A&M leadership has ever heard the phrase, "Make sure you get that in writing?"
-The "Forgotten Seven" (Baylor, Kansas, Kansas State, Missouri, Iowa State, Oklahoma State and Texas Tech) are going to take their portion of the penalty payouts from Nebraska and Colorado and give them to Texas A&M, Oklahoma, and texas. Yes, you read that right, those five schools are so happy to be able to remain in a BCS conference, they are bribing A&M, OU, and texas to stay here with them.
-Beebe is incredibly defensive of texas; seemed to bristle anytime someone questioned their role in this whole melodrama. I guess Dodds didn’t tell him how he was supposed to answer those types of questions.
-Beebe was asked how he would respond to people who said this whole situation was just a major powerplay by texas? His response was, "texas has a lot of influence." Facepalm
-Beebe said several times that Texas A&M, texas, and OU all had other conferences looking at them, that all three had other options, so it was essential to give them a bigger piece of the revenue pie to keep them in the Big 12.
the only good part of all that crap
is: ‘There is no official agreement from all the schools to stay together, just promises, handshakes, and commitments. Technically, this means there is still room for negotiations with other conferences, should a school still be inclined to leave’
just don’t sign anything precluding us from still looking around
So,
Is anyone else slightly worried that we’ve essentially committed to a contract that doesn’t exist? I’m assuming all this talk isn’t legally binding in any way, but I feel like we’re gonna end up with less than we’ve been promised. Possibly a lot less……
Just watched ESPN's top 10 moments in Big 12 football...
and kU/Mizzou of course didn’t crack the top 10….
"I'm pretty sure there's more to life than being really, really, ridiculously good looking. And I plan on finding out what that is."
of course not
I was just happy that they mentioned something other than Nebraska and Texas, because they can do no wrong…
Well obviously
neither team deserved to be ranked that high. If they had, they would’ve been named Texas, or OU, or Alabama, or Florida, etc.
At least MU

"Our administrative team did a good, solid job," Nixon said, "and kept a cool head around them during this process.
"As we stand here today, a newly configured (10-member Big 12) conference has Missouri as one of its leaders. The dollars of that will also certainly be more than we were getting."
Jay Nixon, please shut up. Just shut up.
If it's any consolation...
…Nebraska’s not paying the BigXII for a “buyout.”
Per NU president Harvey Perlman, who’s a lawyer as well as a law professor, the BigXII bylaws have no such buyout clause that everyone’s been speculating about. There is a clause, however, that states any departing school must make the remaining institutions whole for damages incurred by their departure. Well, if you listen to what Dan Beebe said today, the conference isn’t incurring any damages, as a matter of fact it may be “stronger” than it was with NU.
It seems as though Dan Beebe may have shot himself in the foot.

big 12 bylaws
i believe section 3.3 addresses this topic
http://www.big12sports.com/fls/10410/pdfs/handbook/Bylaws.pdf?DB_OEM_ID=10410
It is not a buyout that is paid by NE or CO.
As I understand it, It is a withholding of conference revenues. NE doesn’t have to pay anything. The conference is just going to redirect the monies that would have gone to NE or CO to TX, OU and A&M.
Thank you for your contribution.
this is almost definitely incorrect
there’s a ten million dollar liquidated damages clause that will be enforceable against the teams that are leaving. that’s a really week argument from perlman …
Liquidated damages, what damages are being incurred by the BigXII or it’s member institutions by the departure of Nebraska and Colorado?
The BigXII is apparently going to increase it’s payout from FSN by 500%. How will the BigXII prove incurred damages by the loss of NU and CU in a court of law?
“Oh, these two schools left and you increased your overall television revenue by 280% within a week of them leaving? Yeah, I can see how it hurt your brand.”
Really?

Interesting stuff
But Screwface, is it possible nwtiger1 is right and since NU and CU will be around for 1 and 2 more years respectively that we’ll just withhold their piece of the pie?
I’m sure they’ll attempt to. That was the other half of this. The BigXII distributes the TV money, they can try to withhold NU/CU’s portions, I just don’t know that the BigXII can make a reasonable enough case to prove that damage was done to it’s institutions.

you don't have to prove damages
if there’s a liquidated damages clause that was put in place before the contract was signed and that was reasonable at the time of the signing of the contract. it doesn’t matter if the value of the big 12 has gone up a million percent. that said, it looks like all that’s going to happen is that nebraska’s going to forgo receiving revenue from the conference in the amount of roughly $10 million b/c they didn’t give proper notice of withdrawal. they won’t actually have to pay anything out of pocket, they’ll just get basically nothing from the conference revenues next year.
not that i care. as long as we aren’t getting any of it i hope you guys keep it.
scratch that
it does say you have to repay a percentage of revenue from the past two years, as well as having money withheld for next year.
nebraska already agreed pursuant to the bylaws that leaving the conference without proper notice would result in financial hardship to the remaining institutions. doesn’t matter whether there is actual hardship or not.
Bingo
Liquidated damages don’t require any proof of actual damages.
Also, in response to Screwface’s initial comment, guess who else is a lawyer? Dan Beebe. Further, I’m quite confident the Big 12 has plenty of lawyers, and that they advise Beebe on what to say and what not to say.
We'll carry the banner high!

Don't forget the timing.
NE is set to leave next year. The new TV deal would not go into effect until after the old one expires. The damages you speak of would be for the year in between, I believe.
The whole buyout thing is not true.
The Texas president just came out saying the funds would be distributed “as the league bylaws mandate”. So ummm…ya. 100 posts above are now a moot point.
Annoying You Since 1986
no he didn't
he said “they weren’t a part of any of that” and that they would distribute “money in the Big 12 according to the normal Big 12 distribution.” That certainly doesn’t mean that the top will get more than the bottom as that is the normal Big 12 distribution.

Without pointing to any specific entity in particular, haven’t we had to express reservations about certain student-driven media outlets recently? Are we ready to turn the department’s broadcast presence over to that group of people, many of whom I’ve seen thanking Texas on Facebook in the last 24 hours?
It'll be worth it for every penny of the $567.23

The stadium in Columbia already holds pretty much everyone that wants to go to the home games, most of the road games (including almost all the good ones) are already on tv… I mean, maybe a couple thousand subscribers in the rest of the state… TV makes money by putting eyeballs in front of commercials. Texas is the uber-dog because they have waaaaaaay more eyeballs than we do. This is the basic problem. Everything else is hyperventilating and window dressing, and rubbing people’s noses in things.

Broadcast media is changing. The model we use today won’t work 20 years from now. Those who get ahead of the curve will be the winners. I’m not saying “PUT EVERYTHING ION THE INTERWEBS AND IT WILL BE TEH AWESOME”. I’m saying, start exploring new ways of putting the Mizzou brand out there, particularly beyond our traditional fanbase. We have a great J School, so why not get them thinking about it? Some ideas might not work, but some will. If Mizzou is already at a disadvantage under the old model, what do they have to lose?
By all means, work on it
But they’re still busy trying to figure out how to save newspapers. The Clay Shirky approach (NYU prof) is that no traditional route will work, and the news niche is going to have to get filled with lots of smaller overlapping alternatives… if he’s right, then you are on the money, and we should start experimenting.
