Mizzou Links, 8-4-10
Not the best of days yesterday. A Mizzou assistant gets arrested, two players get ticketed, a former player injures his knee (and for a brief moment, it appears a lot worse than it ends up being), and my back goes out for no apparent reason. Good times had by all.

Walker was sitting in his parked truck with the engine running outside the Mizzou Athletic Training Complex when officers arrived at 11:14 p.m. Walker and the rest of MU's coaches and their wives had returned from a dinner at the Lake of the Ozarks when police were called to check on people "potentially drinking in the parking lot," Weimer said.
Officers interviewed Walker briefly then issued a field sobriety test, leading to Walker's arrest.
Local attorney Bogdan Susan said he would appear in court today on Walker’s behalf and appeal the loss of Walker’s driver’s license.
"Hopefully the facts will come out and we’ll achieve some resolution to this matter," Susan said. "I understand the police have a job to do and we want them to finish their investigation, so I’ll reserve comment until the investigation is complete and all the facts are in."
Team spokesman Chad Moller said MU is aware of the incident and gathering information on Walker’s situation. It's unclear whether Walker will be in attendance at MU’s first practice of the preseason, scheduled for 3:45 p.m. on Thursday. Walker, in his 10th season at MU, is the team’s co-offensive line coach.
The coaches had traveled on a rented bus and were unloading coolers when police arrived. One source said a taxi had arrived at the facility to drive Walker home, but Weimer said he was unaware of the report mentioning a taxi at the scene. "I have no idea about that," he said.

It could be a good thing as in it motivates him to return to form, or it could make him resentful. I hope for the former obviously, but I don’t know what kind of guy he is. From the people closer to the players, what do you think?

What I was thinking. In my pessimistic inner narrative, I read that as if he was kind of pissed about Gabbert getting a lot of attention and the media making so much hype over how pass happy MU’s offense is.

Suspicion of DWI?
That seems somewhat arbitrary. How do they know he wasn’t just running the air conditioner or listening to the radio?
Everyone gets arrested on suspicion
And driving while intoxicated includes sitting in your car if the keys are in the ignition.
Sucks but true.

This is what I was saying yesterday to Bill...
There was a court case a couple years back where the judge ruled you can’t arrest for intent. Just because he was sitting in a car with the engine running doesn’t prove you were attempting to drive. Maybe he was listening to the radio waiting on his cab…maybe he was charging his cell phone…who cares? He wasn’t caught in the act, therefore, there was no crime.
Well, maybe when you took it to court, but as far as the arrest...
The law in Missouri states that simply haviing the keys in the ignition, even if the key is not turned and the car is not turned on, is considered grounds for arrest. Now as far as a conviction, you and your lawyer could try to convince the jury/judge that you didn’t have intent, but as far as the police officer goes, he has every right to arrest you, and the Prosecutor has every right to charge you.

last I checked they couldn’t arrest you for “intent.” That’s all car keys in the ignition is…intent. It’s like having a loaded gun. You can’t arrested for murdering someone…you haven’t done anything yet…it’s just a loaded gun.
What law did he break by sitting in his car drunk? By the very definition of the word, it wasn’t DRIVING while intoxicated….
The statute doesn't require that you drive under the influence
It requires only that you “operate” a motor vehicle. And broadly defined, if the keys are in the ignition and the AC or radio is on, the car is being operated.

That shouldn’t surprise me, really. I’ll leave it to generalities, but I got in trouble with Columbia Police when I was in the Marines. After dicking around with the Boone County court system and the people, it shouldn’t surprise me that there’s such a generally worded phrase. I’m fairly certain a similar statute in California goes on (to great lengths) to define what “operating a motor vehicle” means.

whether or not we agree with the law doesn’t mean we don’t have to be cognizant of it. it’s our job to know the law and abide by it. if he’s drunk and wants a place to sit, sit in the back seat.

Doesn't matter if the keys are in the ignition
Someone I work with got arrested for a dwi while sleeping in the back seat of the car. Was too drunk to drive so decided to sleep it off in his car. Turned on the heater but not the car to keep it warm, and a police officer tapped on the window, woke him up, and arrested him.

it does matter
probably not for the arrest, but for the conviction it does. The courts reversed the interpretation operating about 10 years ago and continue to modify the interpretation based upon legislative changes in the language.
Well that may be true..
But I know from experience that a beating a DWI convicition will easily cost you 2 thousand dollars. Which means you are basically punishing someone for doing the right thing. Stupid, Stupid law.

the right thing? i know i am in the vast minority in here and will probably get ripped, but ok. however, if you are drunk, don’t we all agree that a d.d. is a good idea? this man is in a public position whether he knows it or not. well, i guess he does now. he needs to make better decisions. you can bash the law all you want and i won’t argue. but it IS the law. no getting around that.

But there was a report that a cab pulled up while the officer was arresting him. Not saying it did happen..but what if this is the story..
Coaches all get back. Realize they’ve had too much to drink and call a cab. While waiting for a cab it gets hot, so while they are loading coolers in his car Walker turns on the car to pump the AC while waiting. Cop shows up…and he gets a DWI. I don’t think he did a single thing wrong in that scenario.

well first off
you can arrest for intent. Burglary for instance is the unlawful entry with the intent to commit a crime therein. Moreover, you can be arrested for attempted crimes. Or possession of a controlled substance with the intent to distribute. No actual distribution, just the intent.
Second, there was no arrest for intent here. He was arrested for DWI. Keys in the ingnition alone have been held insufficient to convict. But no case, that I have read at least, has held keys in the ingnition is insufficient to make the arrest. Remember there are 2 standards beyond a reasonable doubt and probable cause. Police arrest on probable cause, not beyond a reasonable doubt. Probable cause is essentially “more likely than not.”
Finally, Driving “means physically driving or operating a motor vehicle.” Operating the vehicle is what is left to interpretation. Engine running and a depressed brake pedal has been interpreted as operating the motor vehicle.
In fact..
There is some legislature out there where Missouri is trying to get more tough. They want to include “just having the keys in the car” as grounds for a dwi. The keys could be in your pocket while you sit in the front seat and they could arrest you for it. Car doesn’t have to be turned on, or even in the ignition.
